Former British protectorate, independent since 1 January 1984 within the Commonwealth, the country is governed by a sultan, head of state and prime minister, in whose hands all powers are concentrated, assisted by 4 councils: religious and private (both advisory), ministers (assisting the sultan in the exercise of executive power) and succession (which decides, in case of need, the replacement of the throne). Legislative power is exercised with the help of the Legislative Council. The constitutional dictation, dating back to 1959, was amended in 1965 and 2004, but in 2005 the sovereign eliminated the changes, which concerned the number of members of the Legislative Council previously raised to 45. The monarchy is hereditary. The judicial system in use in the country is based on British and Islamic law and is divided into three levels of judgment: the Courts of Magistrates and Religious Courts (lower level); the Courts of Appeal (second degree); the High Court (upper level) which has unlimited civil and criminal competences. The death penalty is formally in effect. The armed forces are divided into the three traditional weapons (army, air force, navy) and the military service is carried out on a voluntary basis. Education given in the country is compulsory and free for 12 years from 5 years of age. Primary school lasts for 6 years and starts at 6 years of age. Secondary school generally begins at 12 years of age, lasts 7 years and includes a compulsory 5-year first cycle and a two-year course, preparatory to higher and university studies; Islamic teachings are an integral part of the school curriculum. Despite the University of Brunei Darussalam was founded in 1985, still many students choose to undertake university studies abroad. The state, committed for several decades to improving the school system, has undertaken various measures to support education in the country, including the construction of schools in peripheral areas and the coverage of a range of expenses, such as transport costs and accommodation for students living away from the school within a set radius and part of the costs incurred by students residing abroad. Also thanks to these measures, Brunei’s illiteracy rate is quite low (5% in 2008).
